Conrad Murray Not Expected To Serve Full Four Years

Legal expert Mike Cavalluzzi tells MTV News he isn't surprised by sentence but doesn't think it's justified.

<P>Though he dodged a potential four-year prison term, former <a href="http://www.mtv.com/music/artist/jackson_michael/artist.jhtml">Michael Jackson</a> physician Conrad Murray was sentenced to an equal amount of time in Los Angeles County Jail on Tuesday (November 29) in the death of the pop singer. </P><P> </P><P></p><div class="player-placeholder right" title="Michael Jackson Doctor Conrad Murray Sentenced" id="vid:714975.id:1673923" width="240" height="211"></div><p> </P><P> </P><P>But the same overcrowding problems that spared the cardiologist from doing time in a federal pen might also save him from serving his entire sentence in county as well. Shortly after the <a href="/news/articles/1675062/conrad-murray-sentence.jhtml">sentence was handed down</a> by Los Angeles Superior Court Judge Michael Pastor, Los Angeles Sheriff spokesman Steve Whitmore told <a href="http://www.eonline.com/news/jackson_family_reacts_conrad_murrays/277336" target="_blank">E! News</a> that Murray would likely end up serving "a little less than two years." Due to overcrowding, most county jail sentences are immediately cut in half, and given the 46 days credit Murray has already been given, he is looking at even less than that. </P><P> </P><P><a href="https://www.facebook.com/mtvnews/posts/199210760161755" target="_blank"><b>Do you think Conrad Murray deserved the maximum sentence? Let us know on Facebook.</b></a> </P><P> </P><P>Murray's lawyers said afterward that they believed the sentence was unnecessarily long. "Yes, of course [Judge Pastor] was harsh. He gave the stiffest penalty he was entitled to give under the law," Murray's attorney, J. Michael Flanagan, told reporters. "He was openly hostile. ... [Murray has] led 56 years of exemplary life. He was really dreading [sentencing]. I think anybody would dread going into it. He's an honorable man, and he'll get through this. The family is suffering more than Dr. Murray is. ... Dr. Murray is the provider in that family." </P><P> </P><P>Pastor had leeway in the sentencing, with options ranging from probation to the full sentence, but in a lengthy ruling from the bench, he said Murray's lack of remorse and negligent behavior called for the highest possible penalty. "He is and remains dangerous ... the request of probation is denied, the court imposes the high term of four years imprisonment in this case," Pastor said during the 90-plus-minute hearing. </P><P> </P><P>Los Angeles-based criminal defense attorney Mike Cavalluzzi told MTV News that he wasn't surprised by the sentencing but that he didn't believe it was justified. Cavalluzzi said Pastor had incentive to give the full sentence because of the prominence of Jackson and his family and to create the perception that he is tough on crime. "He gets that perception by sentencing him to the max while not having to surrender the defendant to the full sentence," said Cavalluzzi, who was not involved in the case. "He gets the self-satisfaction of being perceived as being tough on crime and making the Jackson family happy, but I don't think it was a fair sentence." </P><P> </P><P>Cavalluzzi said when deciding prison versus probation, judges have to look at someone's criminal history and whether a person is likely to complete the terms of their probation, which he believes Murray would. "I'm not seeing aggravating factors here, and I think it was just a chapter in [Murray's] life and he does not have a history of being a mercenary doctor always after money, but of being a good, responsible doctor who was seduced by the celebrity and money that Jackson offered," he said. </P><P> </P><P></p><div class="player-placeholder right" title="Michael Jackson's Former Doctor Guilty Of Involuntary Manslaughter" id="vid:708788.id:1673923" width="240" height="211"></div><p> </P><P> </P><P>As to why Pastor gave such a dramatic, lengthy explanation for why he was sentencing Murray to the max, Cavalluzzi said the judge has to have a justification for his actions in the public record. "Because he doesn't have the discretion to give a high prison term, [Pastor] has to justify his sentence in the record and have very specific reasons for it. I don't think there's any way that anyone truly believes that from this day forward Dr. Murray truly represents a threat to society. That's just ludicrous." </P><P> </P><P>And while he doesn't agree with the four-year term, Cavalluzzi said the high-profile nature of the case and the glare of the media could have played into the sentence. "It probably gives [<a href="/news/articles/1675068/conrad-murray-sentencing.jhtml">Jackson's family</a>] great comfort to have someone to blame," he said. " 'If not for this awful man, my son, brother, father would be alive.' But it's not fair to do that and it feels like a capitulating judgment in favor of feeding the emotional needs of the family." </P><P> </P><P>Upon leaving the courthouse, Michael's brother Jermaine, when asked if the four-year sentence was enough, shook his head and said, "No." Mother Katherine Jackson told local TV station KTLA, "Four years is not enough for someone's life. It won't bring him back. But at least he got the maximum, and I thought the judge was very, very fair." </P><P> </P><P>The prosecution, however, was satisfied with the ruling. </P><P> </P><P>"We're pleased. That's what we thought was appropriate. The judge obviously agreed with us," deputy district attorney David Walgren said. "It was our position that it was not a simple, one-time mistake; it was a series of mistakes culminating in the abandonment of Michael Jackson when he died ... the judge agreed with that sentiment. A brother and a son and a family member was killed, and whatever the sentence may be, the family of the victim deserves justice. And we did everything to bring them that justice." </P><P> </P><P>As for how much time Murray will spend locked up, Cavalluzzi said it is likely to be less than two years and, frankly, he predicted, the doctor could be out even sooner than that. "He might be eligible for house arrest very quickly," he said.</p>

Couple likely 'trying to protect what they rightfully own or created,' family law expert tells MTV News.

<P><a href="/music/artist/knowles_beyonce/artist.jhtml">Beyoncé</a> and <a href="/music/artist/jay_z/artist.jhtml">Jay-Z</a> have filed an application with the U.S. Patent and Trademark Office to protect their month-old baby's name and reserve it for future use, MTV News has confirmed. The superstar couple reportedly sought the trademark to stop the use of Blue Ivy's name by others. </P><P> </P><P></p><div class="player-placeholder right" title="A Gift Buying Guide For Blue Ivy Carter" id="vid:725377.id:1676907" width="240" height="211"></div><p> </P><P> </P><P>It's a smart move, according to family law attorney and author <a href="http://www.vikkiziegler.com/" target="_blank">Vikki Ziegler</a>. "[Seeking the trademark] forestalls competitors from using the child's name and or third parties from attempting to sell the baby's name back to the couple," Ziegler told MTV News. "They are likely trying to protect what they rightfully own or created, shall we say, by trademarking Blue Ivy's name." </P><P> </P><P>The application to trademark Blue Ivy Carter's name, filed by BGK Trademark Holdings (Beyonc&#233;'s company) is currently pending but will likely be approved because, as the <a href="http://www.washingtonpost.com/blogs/reliable-source/post/blue-ivy-the-trademark-feds-move-fast-on-rights-to-beyonce-and-jay-zs-babys-name/2012/02/03/gIQAOTDGnQ_blog.html" target="_blank"><i>Washington Post</i></a> reports, parents are legally authorized to trademark the names of their minor children. </P><P> </P><P>"In essence, it's a trademark for a brand, and this brand is expected to be one hot commodity &#8212; just look at Blue Ivy's parents," Ziegler said. "Anyone else that tried to use the name after the trademark was approved could be sued and held liable for damages." </P><P> </P><P></p><div class="player-placeholder right" title="Beyonce Will Emerge As A Hollywood Celebrity Mother Brand" id="vid:724613.id:1676907" width="240" height="211"></div><p> </P><P> </P><P>While the Patent Office looks fondly on attempts to trademark the name of one's own child, attempts to do the same with the names of other people's kids are another story, as two designers learned when they sought &#8212; just days after Blue Ivy's birth &#8212; to trademark the baby's name for their own use. </P><P> </P><P>Applications from fashion designer Joseph Mbeh to patent "Blue Ivy Carter NYC" and by an unnamed designer to trademark "Blue Ivy Carter Glory IV" for a fragrance line were denied by the Patent Office, which noted in its decision that the name belonged to a "very famous infant" and consumers would wrongly assume that any products bearing the name had been approved by Beyonc&#233; and Jay-Z. </P><P> </P><P>Ziegler noted that the trademark would "protect against others using the child's name as a brand of merchandise in the same marketplace," so it will not impact the "Blue Ivy" trademark held by a clothing boutique in Sturgeon Bay, Wisconsin. The store filed to trademark <i>its</i> name on January 19, 2011, a year before Queen B and Jay made the name famous. Spend a year with Grudge training center in new web series

Unless you're training for a fight, it's hard to understand the ins and outs of an MMA gym. Even people who train part-time struggle to know just how difficult the days and weeks are for fighters working full-time to prepare for a bout.

With that in mind, MMA Fighting's Ben Fowlkes decided to spend a year with Grudge Training Center in Colorado. Home to Shane Carwin, Brendan Schaub and Nate Marquardt, Fowlkes worked with head trainer Trevor Wittman to get an inside look at what happens in an MMA gym over the course of year, and chronicle it in the must-read series, "The Hurt Business."

What Fowlkes didn't anticipate was how eventful 2011 would be for Grudge. Marquardt went from a UFC contender to unemployed after failing to pass medicals for his UFC on Versus fight in June. Schaub's red-hot streak was stopped by Antonio Rodrigo Nogueira in August. Carwin lost to Junior dos Santos in June and then did not fight again in 2011 because of injuries.

Fowlkes spoke to Cagewriter, and admitted he had no idea how the year would turn out when he first spoke to Wittman.

"I chose Grudge for two reasons, really. One, Denver is close enough to where I live in Montana that I could get down there often enough," Fowlkes said. "And two, Trevor Wittman was the only trainer I talked to who seemed as interested in the idea as I was. The others I mentioned it to were like, 'Yeah, that would be cool project...for you to do at someone else's gym.'"

It was in those many days spent at the gym where Fowlkes, who has covered MMA since 2006, truly gained an appreciation for what fighters do on a daily basis.

"I feel stupid for admitting this, but I think what surprised me the most was how much work fighters put in before they ever do the work that actually gets them paid. You see Brendan Schaub in the gym two months before his fight with Cro Cop, and he's at work. This is his job. And yet, no one's paying him to be there. If he decides to blow it off for a day or two, it's on him. If he does all the work as best he can in the gym and then loses, it won't even matter to a lot of fans, because they didn't see what he went through just to get to the fight. It's one of those things where you know, intellectually, that they're working hard in the gym before a fight. But until you see that grind day after day, it's hard to really appreciate."

Fowlkes originally hoped to write a book out of his time with Grudge, but decided it would work better as a web series. In the first installment, he wrote about Grudge in January of 2011, when everything seemed to be humming along smoothly for Wittman and his fighters. As the series unfolds, readers will learn about a year that was anything but typical.

"[Readers] should expect a lot of change, for one thing. Grudge at the end of the year was nothing like Grudge at the beginning. They should also expect the story to move around a lot, to UFC 128 in New Jersey in the second installment, to Vancouver for the Shane Carwin-Junior dos Santos fight, and even to Brazil for Schaub's fight with Nogueira. We're also going to get more into the economic realities of the gym, who's paying who, and how much, and how that causes friction. Of course, Nate Marquardt's whole situation with TRT and getting fired from the UFC will be covered. And there's also some stuff about the lesser-known fighters at the gym, the ones who are struggling to make their way and finding out how tough it can be."

Will Black Keys Team Up With Ke$ha? First They Want Jim Nabors

The duo sat down with MTV News in Berlin to discuss a pair of unlikely collaborations.

<P>Theirs is a relationship that has spanned time and Twitter, <a href="https://twitter.com/#!/keshasuxx/status/77286418598211584" target="_blank">seafood</a> and <a href="https://twitter.com/#!/keshasuxx/status/157523381602889728" target="_blank">shaving</a>, but over the years, the unlikely bond between the <a href="http://www.mtv.com/music/artist/black_keys/artist.jhtml">Black Keys</a> and <a href="http://www.mtv.com/music/artist/id_3213641/artist.jhtml">Ke$ha</a> has grown to become something <i>more</i>: a genuine friendship, marked with the occasional trespassing charge. </P><P> </P><P></p><div class="player-placeholder right" title="Would The Black Keys Ever Collaborate With Ke$ha?" id="vid:731631.id:1678505" width="240" height="211"></div><p> </P><P> </P><P>"We're friends with her, we've known her since way before she was famous, before she was even a singer, I guess," Keys drummer Patrick Carney told MTV News. "When she was 16 years old, she used to sneak into our shows. We kind of became friends with her by kicking her out of our backstage room, over and over again. She actually has snuck into shows in L.A., San Diego, Coachella ..." </P><P> </P><P>"She snuck in and [got] kicked out of one show, like, <i>five</i> times," frontman Dan Auerbach added. "[She] snuck in through the kitchen. I don't know if she's such a big fan; she just likes breaking the rules." </P><P> </P><P>So, when MTV News sat down with the 'Keys in Berlin during the premiere of their <a href="/news/articles/1678662/black-keys-gold-on-the-ceiling-music-video.jhtml">"Gold on the Ceiling"</a> video, we had to ask if their friendship with Ke$ha would take the next step: an actual musical collaboration. It's not all that far-fetched, considering both Ke$h and Auerbach live in Nashville ("I see her every once in a while flying by in her T-Top [convertible]," Auerbach laughed), and recently, the glittery one has logged studio time with <a href="https://twitter.com/#!/keshasuxx/status/160846424609787906" target="_blank">the Flaming Lips</a>. So, could we see a team-up on the next Black Keys album? </P><P> </P><P>"I guess, I don't know," Carney said. "We don't really do that many collaborations, really." </P><P> </P><P>OK, so if a Ke$ha collabo isn't in the cards, just who would the 'Keys like to work with next? Well, as it turns out, they've got their eyes set on landing a very big star for the next record ... even if they mistakenly believe he's deceased. </P><P> </P><P>"We both want to work with Jim Nabors very badly, but apparently he's not with us anymore," Carney said. </P><P>Oh, <a href="http://www.jimnabors.com/" target="_blank">but he is.</a> Which means that, much like Nabors, the dream is alive. Yamaha Factory Racing made a purposeful start to the final 2012 pre-season test today at the Jerez circuit in Spain. Riders Jorge Lorenzo and Ben Spies were out for the first time in the new racing livery and looking very comfortable on their 1000cc YZR-M1s. Today was the first opportunity to test this evolution of the 1000cc M1 at a different track to Sepang. Spies was the first rider to break under the 1’40 lap barrier with a 1’39.984, with team mate Lorenzo following quickly to take the lead with a 1’39.956. Lorenzo continued to pick up speed on one of his ‘home’ tracks, completing the first of the three days as the second fastest rider with a time of 1’39.419, 0.273 seconds behind Casey Stoner in first. Spies wrapped up the day in fourth having completed a race simulation, 0.838 seconds from first.

“Today was a very long day because we started at 10am and finished at 6pm. We did a lot of laps and it was very interesting to see how different the bike was compared to Sepang because it’s a different track. Here it is much slower and more corners, not so many straights. The 1000cc is not so easy compared to the 800cc here. At the end of the day we were able to be very fast and stay in the first three positions so we are satisfied.”

“Today was a positive day; we actually got more than we thought accomplished. We were able to look at the two tyres Bridgestone wanted us to test and also went through a couple of different settings on the bike. We did a race simulation to get one out of the way and we might do one more before the end of the test just get me and the bike in tune for that many laps. Today’s was to test the fuel consumption and we were happy with that. We can now focus pretty much on going fast and trying to improve the bike lap time wise and also improve me around the track! This isn’t a strong track for me so I’m quite happy that we’ve shown some decent pace around here. We’ve got a lot done and it’s been a good day.”



Crutchlow and Dovizioso begin final preparations in Jerez

Monster Yamaha Tech 3 Team riders Cal Crutchlow and Andrea Dovizioso kicked off their final preparations for the 2012 MotoGP World Championship with a positive and productive first day of testing at the Jerez circuit in Spain.

Crutchlow continued his outstanding winter testing form to set the fifth fastest time on Yamaha's impressive new YZR-M1 1000cc machine. Evaluating different set-up options to improve stability on acceleration, the British rider's best time of 1.40.130 ensured he was the quickest non-factory team rider and he was less than 0.2s behind factory Yamaha rider Ben Spies.

Having made only one previous visit to the Jerez track in his career, Crutchlow completed a marathon stint of 74-laps to build-up his experience of the circuit. He also managed to gather vital information on Bridgestone's hard compound rear tyre option, improving his feeling and confidence throughout to continue the momentum gained in two morale-boosting test sessions at the Sepang circuit in Malaysia.

Dovizioso, who celebrated his 26th birthday today, was eighth quickest but the Italian was unable to show his true potential having been struck down by a stomach bug overnight.

The illness meant Dovizioso was forced to ride in considerable discomfort during the day but he was still able to complete 46-laps and gain more experience of riding Yamaha's YZR-M1 machine. A quickest time of 1.40.665 put him eighth on the time sheets and less than 0.2s away from the top six. He is confident with a good night's rest he will be in better physical shape to post a more competitive pace tomorrow.



Cal Crutchlow

Position: 5th Time: 1'40.130 Laps: 74

“Today was a positive start to the test and important for me to carry on the momentum we gained in Sepang. I did a lot of laps but I have to do that because this is only my second time at this track and I need to gain some experience so I am in the best shape possible when we return for the race next month. We have made really good progress with the set-up of the bike today and it is good that we have come to a completely different style track compared to Sepang and the bike is working well. We are always looking to improve and the bike is still a bit of a handful to manage exiting the corner, but a real positiv e is that I did my best time today on the hard rear tyre. Last year on the 800 I could never really use the hard tyre, so I'm pleased about that because today I only did five laps on the soft tyre. Another big plus is my consistency. We talked about improving that over the winter and I've definitely improved in doing more constant times, so it has been a really productive start to the test.”



Andrea Dovizioso

Position: 8th Time: 1'40.665 Laps: 46

“I was really looking forward to starting this test today because it is a very important three days for me. It is my birthday too and I was looking forward to gaining more experience with the Yamaha. This morning though was not easy because I didn't have the same good feeling with the bike as I did at the last test in Sepang. Thanks to my Tech 3 crew we found a much better setting but unf ortunately I wasn't able to exploit it because of my physical condition. I had some problem with my stomach and I had zero energy and I am sorry I could only make 46-laps. The most positive point of the day was some new electronics I tried which helped stability exiting the corner. But we can still improve more in this area. I am not worried about the gap to the front because I didn't feel in a good enough physical condition to push hard.”
