Report: UK judge finds mom culpable for child's injuries because of incorrect child seat

Any time a parent's poor judgment results in harm or injury to a child, it's a sad case. This story, however, seems particularly tragic. According to The Telegraph, a British woman whose daughter was seriously injured in a car crash was found negligent and partially responsible for her daughter's injuries because the girl was riding in an inappropriate child safety seat.

While the accident was judged to be entirely the fault of the other driver, according to the report, his insurance company insisted that part of the responsibility for the girl's injuries fell on her mother. Despite having an appropriate car seat with a five-point harness in the vehicle, the three-year-old girl was riding in a booster seat designed for older children. The judge agreed with the insurer and ruled that the mother was 25 percent liable for her child's head, spinal and internal injuries, which the report said will affect her for the rest of her life. The decision means the woman will receive less financial compensation from the insurance company.

While we're sure that the woman - who was described by the judge as "an excellent and caring mother," according to the report - feels no small measure of guilt, her case reinforces the necessity of proper seatbelt and child safety seat use. Besides the wedding and undeniable modern-day freshness William and Kate bring to the world, they have also made headlines for getting their own wax figures unveiled in London and New York by Madame Tussauds, as well as meeting the Obamas and other Hollywood A-listers.

Though we don't know what's ahead for the next year of marriage, we can only assume it will include more head-turning glamorous fashions and commendable charity efforts.

Damp Start to #Jerez Grand Prix of #Spain

The Grand Prix of Spain got underway today at Jerez with mixed weather conditions providing a frustrating experience. The majority of the MotoGP riders were forced to sit out the morning session as track conditions which were not fully wet or dry meant no valuable set up data could be assessed. The second session in the afternoon proved equally frustrating, starting wet but gradually drying over the 45 minutes.

Championship leader Lorenzo spent the afternoon hunting extra grip from the rear as the wet tyres quickly degraded on the drying track. Team mate Spies concentrated on finding an optimum tyre set up for the first half of the session, also making some small set up adjustments in the hunt for optimum performance.

Position 4th - Time 1.51.873 - Laps 13

“This morning we couldn’t practice and this afternoon it was wet and then finally drying at the end. In these conditions we are not so good because the middle of the tyre is dropping a lot, after eight or ten laps we don’t have any more grip so we have to slow the pace. We have to work on that for Sunday if the conditions are going to be the same as today. If it rains with a lot of water then that’s one story but if it’s like today we are not the fastest so we need to gain some grip on the rear.”


Ben Spies

Position 10th - Time 1.53.409 - Laps 18

“Today was good, we started with a wet track and we had to fiddle round with some tyre pressures for a while. We got that sorted and made some changes to the bike to the point where I was comfortable. The tyres had got quite bad by that point; the times were dropping so we were slower, but still as consistently fast as everyone out there. I’m looking forward to tomorrow to see what we can do.”

Solid start for Dovizioso and Crutchlow at rain-hit Jerez

Monster Yamaha Tech 3 Team riders Andrea Dovizioso and Cal Crutchlow began their preparations for the start of the European phase of the 2012 MotoGP World Championship in challenging and unpredictable conditions at the Circuito de Jerez in Spain today.

Track conditions in this morning's opening practice session weren't sufficiently wet to evaluate Bridgestone rain tyres or dry enough for slicks, and with no possibility of carrying out any meaningful set-up work, Dovizioso and Crutchlow didn't complete a single lap.

The tricky track conditions remained for this afternoon's second practice, with the session commencing on a wet track under threatening grey and cloudy skies. Patches of dry tarmac started to appear by the end of the session but Dovizioso and Crutchlow spent their time exclusively assessing Bridgestone's wet weather tyres in case Sunday's 27-lap race takes place in similar conditions.

Dovizioso was sixth quickest on board his Yamaha YZR-M1 machine this afternoon and seventh on the combined timesheets. His best time of 1.53.070 ensured he finished leading non-factory rider but the Italian is looking to improve rear traction in the wet with rain forecast to play a major part in proceedings for the rest of the weekend.

British rider Crutchlow, who made a sensational start to the 2012 campaign in Qatar earlier this month when he claimed a maiden front row start and fantastic fourth position, was only 0.3s behind his team-mate.

The 26-year-old set a best time of 1.53.352, which put him eighth quickest in the session and ninth overall ahead of factory Yamaha rider Ben Spies. He too will concentrate on improving rear grip in tomorrow's final practice and qualifying sessions.

Position 7th - Time 1.53.070 - Laps 11

“It has been a day of pretty much constantly changing weather and track conditions and unfortunately that meant we were not able to try anything on the set-up of the bike. We did not have dry conditions at all and even though it has been raining we didn't get the chance to ride in full wet conditions. I went out to try the bike because we might have the same conditions for the race on Sunday, s o it was important to go out and collect some information. For tomorrow I just hope that we can do some more meaningful work. I don't care if it is wet or dry but anything is better than mixed conditions so that we can focus on improving the bike.”


Cal Crutchlow

Position 9th - Time 1.53.352 - Laps 15

“If we get more of the same conditions for the rest of the weekend then we have a lot of work to do. To be honest we struggled a little bit with a lack of rear grip and that is where we are going to have to work on because we could be racing in similar conditions on Sunday. This track dries really fast and with the rain tyres we are having a lot of spinning. Although we've got some issues with the rear grip, I am really happy with my position on the timesheets considering the problems and that makes me really confident that if we make the settin g better I will be very competitive.”

Video: Audi releases first Truth in 24 II trailer

Truth in 24 II Trailer

Three years ago, Audi released the documentary Truth in 24 highlighting its three-car effort at the 24 Hours of Le Mans. Despite the Four Ring's success at the race in the last decade, they were undoubtedly the underdogs to the much faster Peugeot teams that year, making for a Hollywood-like ending when Audi managed to take home the victory with teamwork and a little help from the weather.

The first film was such a success that Audi announced earlier this year that they would release Truth in 24 II, once again featuring their three-car team battling Peugeot at the world's most famous endurance race. We're fully expecting the film to be packed with drama, as last year's 24 Hours of Le Mans was one of the most action-packed and closest races of all time. Two bad crashes ended the race for two of the Audi teams, leaving a single R18 TDI to battle the Peugeots.

Sadly, with Peugeot having pulled out of the sport quite suddenly in January, it will also be the last such battle at Le Mans for the foreseeable future - all the more reason to watch the documentary when it comes out in a few weeks. For now we just have the trailer, which you can watch by scrolling below.

Surprise, surprise: UFC light heavyweight champion Jonny "Bones" Jones took home the biggest paycheck of any fighter on the UFC 145 fight card, where he defended his title for the third time. Alistair Overeem blames anti-inflammatory medication containing testosterone for elevated T/E ratio, failed test

Hulking heavyweight Alistair Overeem, who lost a shot at the UFC heavyweight title when he failed a March 27 random drug test administered to him by the Nevada Athletic Commission, said in a statement Monday released by his management team that the reason for his failure was medication he was given to treat a rib injury.

Overeem, who had a 14:1 testosterone-to-epitestosterone ratio that was more than twice the legal limit of 6:1 in Nevada, was on Friday pulled from the title fight against champion Junior dos Santos that was to be the main event of UFC 146 on May 26 in Las Vegas by UFC president Dana White and replaced by Frank Mir.

The failure was first announced by the Nevada commission on April 4, noting that Overeem's T/E ratio exceeded 10:1. The next day, it announced that the exact number was 14:1.

Overeem had a hearing scheduled in front of the Nevada commission on Tuesday, but White said Saturday after UFC 145, "I'm not too optimistic" that Overeem would get licensed and that the UFC had marketing deadlines it had to meet. He said the UFC couldn't deal with the uncertainty and ultimately pitted Mir against dos Santos.

In his statement, Overeem said in March he was given an anti-inflammatory medication, which he did not identify, that was mixed with testosterone to treat a rib injury.

His elevated T/E ratio was discovered following a surprise test given by the Nevada commission on March 27 to all six of the heavyweights who were participating in a news conference that day. The others -- dos Santos, Mir, Cain Velasquez, Antonio "Big Foot" Silva and Roy Nelson -- all passed the test.

Prior to the UFC 146 press conference in March, I aggravated an old rib injury on my left side. My doctor prescribed, and I accepted, an anti-inflammatory medication that was mixed with testosterone. I was completely unaware that testosterone was one of the ingredients in the medication. Although I was unaware, I do realize it is my job to know what I am putting into my body.

Overeem has fought under a cloud of suspicion for years, though he had never failed a test previously. He used to fight as a light heavyweight at 205 pounds, but moved to heavyweight and bulked his body up tremendously.

In his statement, Overeem vehemently denied using PEDs and supported the commission. His entire statement:

To my friends and fans,

I am deeply saddened to announce that on Friday, April 20, I respectfully withdrew from the May 26 event so that I can request a continuance until my situation with the Nevada State Athletic Commission is resolved.

I cannot express how sorry I am to the Commission, Junior Dos Santos, the fans, the owners and employees of the UFC, my friends and family and anyone else who this has affected.

I absolutely do not believe in, nor do I use performance-enhancing drugs. I am a clean fighter and I will do whatever it takes to prove this to everyone.

There is no date set for Overeem's formal hearing. He is facing no punishment because he did not have a license at the time of the test, but he would have to explain the elevated ratios to the athletic commission when he applies for a license after he's ready to fight again. He can choose not to apply for a license in Nevada again, but he almost certainly wouldn't be able to fight in the state unless and until he met the commission face to face and explained himself, even if he does so elsewhere first.

Brian Stann knocks out Alessio Sakara, then stops fight without help from referee (VIDEO)

UFC middleweight Brian Stann is a fighter, a Marine, and recently, a commentator for Fox. He's used to wearing many hats, so it's no surprise that during his UFC on Fuel 2 win over Alessio Sakara, he was both fighter and referee.

Stann knocked Sakara down with a bevy of knees in the first round. While in Sakara's guard, Stann knocked his opponent out with short elbows. When he saw Sakara was clearly out, he pulled back, waving to referee Marc Goddard that Sakara was knocked out.

Though MMA rules indicate Stann would not have been wrong to continue the bout until Goddard stepped in, he didn't want to inflict any more damage on Sakara.

Immediately after the bout, UFC president Dana White tweeted, "Brian Stann is one of the classiest people on Earth!" Light heavyweight champ Jon Jones, a training partner of Stann's, called the win "very classy" and "good for the sport."

Stann is already known as one of MMA's good guys. He started fighting after a decorated career with the Marines. He founded Hire Heroes, a not-for-profit whose aim is to help veterans transition to civilian jobs. Just before he was scheduled to leave his Atlanta home to train for the Sakara fight in New Mexico, his brother-in-law died. Instead of leaving his grieving wife, Stann trained at home and communicated with his coaches through videos.

As Ben Fowlkes from MMA Fighting wrote, he's such a good guy, you almost want to hate him. Except, he's also the kind of good guy who will stop a fight when he sees his opponent has been knocked out.

RAIN ARRIVES ON CUE FOR ASSEN QUALIFYING




The weather had a dramatic effect on this afternoon's opening qualifying session for the third round World Superbike championship event at Assen in The Netherlands as rain fell just as riders took to the circuit.
Following a dry free practice this morning, local radar forecasts predicted rain at 15.30, the scheduled start of first qualifying, with most riders trying to get a ‘banker’ lap in before it arrived.
Honda World Superbike rider Jonathan Rea set the fifth fastest time but his team-mate Hiroshi Aoyama was unable to set a competitive time, ending the session in provisional 21st place as French rider Sylvain Guintoli went fastest.
Rea had spent the morning session continuing the work on the front end feeling from his Honda CBR1000RR, while a technical problem and SBK’s new-for-2012 ‘one-bike’ rule limited Aoyama’s track time.

It was quite a weird session this afternoon, to be honest. My guys in the pitbox were monitoring the weather really closely and we could see on the radar that bang on 3.30 there was going to be a shower, with more to follow. So we knew that the first lap was going to be crucial and went out with the softer tyre but already on the first lap I got some spray on my visor. So you could say I took a slightly more conservative approach to getting a banker in, and even then it was getting heavier. How the other guys went the same speed as they did in the first session is beyond me – I wasn’t wanting to take too many risks. In the free practice we made some OK steps with the bike, which is completely different to the race set-up we had here last year. I’m still lacking a little bit of front-end feel but I think it’s the right way to go and we’re slowly getting it sorted. So, this afternoon was a bit of a wasted session – I was the only guy t o go out on intermediate tyres and the feeling from them wasn’t that good to be honest. If it’s like this again tomorrow, I’ll take to opportunity to go out and build my speed on them because it looks like Sunday might be the same conditions that we had today.

We didn’t start so well this morning with a technical problem so we missed the beginning of this morning’s session. The team fixed the problem very quickly so I was able to go out for the second half of the free practice. We wanted to try some things but we didn’t have enough time, which was a pity. We were going to re-confirm this afternoon but the rain came so it wasn’t possible. We knew the rain was coming but wanted to check the setting with the harder tyre – I pushed as hard as I could on that tyre but it was quite difficult to get the feeling. So, it’s been a pity to lose the opportunity to check things this morning and to make a good lap time this afternoon. We have another qualifying session tomorrow so I really hope it will be dry for that.

We played around looking for some improvements on some known settings with Jonathan this morning, trying to keep things moving forward. He rode on the harder tyre throughout the session, too. We still haven’t quite found the correct setting for the dry but, with the harder tyre, it wasn’t so bad in the end. This morning we had a technical problem with Hiroshi’s bike which sidelined him for most of the session. This was really disappointing because we needed the time quite badly as we search for a better setting, and that was the morning pretty much lost. In the afternoon the riders only got one dry lap. Jonathan is the master at going fast out of the box so there were no problems, but Hiroshi is a little slower getting up to speed and, with only one lap, it was difficult for him. On wet settings, Jonathan was in the top three, but we may get another chance to work on that tomorrow.

Jon Jones’ next opponent: Dan Henderson

After Jon Jones defended the UFC light heavyweight belt with a win over Rashad Evans, questions immediately turned to his next opponent. At Saturday's post-fight press conference, UFC president Dana White confirmed Dan Henderson would get the next shot at trying to unseat Jones.

This title shot comes after Henderson had a banner year in 2011. He won the Strikeforce light heavyweight belt, beat MMA legend Fedor Emelianenko, then returned to the UFC with a win over Mauricio "Shogun" Rua in a fight that's considered one of the best of all time.

It will be Henderson's third chance to win the UFC belt. After winning titles in Pride, Henderson lost UFC title shots to Anderson Silva at middleweight and Quinton "Rampage" Jackson at light heavyweight. Back in 1998, Henderson won the UFC middleweight tournament at UFC 17, but that is the only UFC title he's won in his 15-year MMA career.

Though White didn't nail down a date for the Jones-Henderson bout, UFC 149 in Calgary was mentioned as a possibility.

Report: New Jersey adds "road rage" kicker to traffic violations

Angry driver gets his 'road rage' on

A Carnegie Mellon paper gauges that it would take 76 days to read all of the privacy policies for the companies you deal with, and that's before you get to the terms and conditions and other small prints. Judging how quickly states are adding new laws to their driving codes and swapping punishments, staying informed might also require a semester of reading pretty soon.

In honor of a woman who was paralyzed from the waist down as a teenager because of a road rage incident, New Jersey has just made Jessica Rogers' Law official. Rogers was a passenger when the driver of the car she was a passenger in went after another car that cut him off. Rogers' driver subsequently lost control and crashed.

The law upgrades the degree of a vehicular incident - from Disorderly Persons to fourth degree or fourth to third degree - if road rage is established as a factor. How will road rage be established? That will be up to officers and juries to decide. But short of obvious rage-worthy cases like the Oklahoma driver who pulled a gun after being honked at or the Alaska driver who fatally stabbed another, we see a lot of legal wrangling and plea deals plus big fines to go down to aggressive driving.

According to several sites of New Jersey trial attorneys, Disorderly Persons charges come with a maximum of six months in county. Fourth degree ups that to 18 months max, but things get serious at third degree with three to five years in the hoosegow and up to $15,000 in fines. Get ready for enforcement gymnastics, though, for as the wise defendant once said, "It ain't what you know, it's what you can prove."
